1. Definitions
- “Company”: Refers to Therma Tech Inc., its employees, agents, and affiliates.
- “Customer”: Refers to the individual or entity engaging the Company’s services or purchasing its products.
- “Services”: Refers to HVAC installation, repair, maintenance, or any other services provided by the Company.
- “Products”: Refers to any HVAC equipment, parts, or materials sold by the Company.
- “Messages”: Refers to text messages, email notifications, or automated phone communications from Therma Tech Inc. regarding services, scheduling, promotions, or updates.
2. Scope of Services
2.1 Therma Tech Inc. provides HVAC services, including but not limited to installation, repair, and maintenance of heating, ventilation, and air conditioning systems.
2.2 All Services and Products are subject to availability and may require a prior consultation or site inspection.
2.3 The Company reserves the right to refuse service to any Customer at its sole discretion.
3. Pricing and Payment
3.1 All prices for Services and Products are provided in a written estimate or invoice and are subject to change until a final agreement is signed.
3.2 Payment is due upon completion of Services or delivery of Products unless otherwise agreed in writing. Accepted payment methods include cash, check, credit card, or electronic transfer.
3.3 A deposit may be required for certain Services or Products, as specified in the estimate.
3.4 Late payments may incur a fee of 1.5% per month on the outstanding balance or the maximum rate permitted by law, whichever is lower.
3.5 All quoted prices exclude taxes unless otherwise stated. The Customer is responsible for applicable sales taxes or fees.
4. Estimates and Quotes
4.1 Estimates provided by the Company are based on information available at the time and may be subject to change due to unforeseen circumstances (e.g., hidden damage, additional labor, or material costs).
4.2 Quotes are valid for 30 days unless otherwise specified.
5. Warranties
5.1 The Company warrants that Services will be performed in a professional and workmanlike manner consistent with industry standards.
5.2 Products sold by the Company may be covered by manufacturer warranties, which will be passed on to the Customer. The Company does not provide additional warranties on Products unless explicitly stated in writing.
5.3 Warranty claims must be reported to the Company within 30 days of service completion or product delivery.
5.4 Warranties are void if the Customer modifies, misuses, or allows unauthorized parties to service the HVAC system or Product.
6. Customer Responsibilities
6.1 The Customer shall provide the Company with access to the property during agreed-upon times for service or installation.
6.2 The Customer is responsible for obtaining any necessary permits unless otherwise agreed in writing.
6.3 The Customer must inform the Company of any known hazards (e.g., asbestos, mold, or structural issues) before the start of work.
7. Cancellations and Refunds
7.1 Cancellations of scheduled Services must be made at least 24 hours in advance, or a cancellation fee of $50 may apply.
7.2 Deposits are non-refundable unless the Company is unable to perform the agreed-upon Services.
7.3 Installed Products or completed Services are non-returnable and non-refundable unless defective and covered under warranty.
8. Limitation of Liability
8.1 The Company is not liable for damages caused by pre-existing conditions, acts of God, or Customer negligence.
8.2 The Company’s liability for any claim arising from Services or Products shall not exceed the total amount paid by the Customer for the specific Service or Product in question.
8.3 The Company is not responsible for indirect, incidental, or consequential damages, including loss of use or business interruption.
9. Messaging and Communications
9.1 Types of Messages
By providing your phone number and/or email address, you agree to receive communications from Therma Tech Inc., including but not limited to:
- Messages about scheduling, service confirmations, and appointment reminders.
- Updates regarding your service request, including status changes.
- Promotions, special offers, and limited-time discounts.
9.2 Message Frequency Disclosure
- Message frequency may vary based on service requests, appointment updates, and promotional campaigns.
9.3 Message and Data Rates
- Message and data rates may apply based on your mobile carrier’s terms.
9.4 Opt-Out Information
- You may opt out of receiving SMS messages at any time by texting STOP to unsubscribe.
- For email communications, follow the unsubscribe link in the email footer.
- Opting out of marketing messages will not prevent necessary service-related communications.

10. Termination
10.1 The Company may terminate any agreement or service if the Customer fails to make payment, breaches these Terms and Conditions, or engages in abusive or unsafe behavior toward Company personnel.
10.2 Termination by the Company does not relieve the Customer of payment obligations for Services already rendered or Products delivered.
11. Dispute Resolution
11.1 Any disputes arising under these Terms and Conditions shall first be addressed through good-faith negotiation between the parties.
11.2 If unresolved, disputes shall be submitted to mediation in San Jose, California, before proceeding to binding arbitration or litigation, as permitted by law.
12. Governing Law
12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
12.2 Any legal action arising from these Terms shall be filed in a court of competent jurisdiction in Santa Clara County, California.
13. Changes to Terms and Conditions
13.1 The Company reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be effective upon posting to the Company’s website or notification to the Customer.
